In late 2009, a decision was made by the Queensland Government to refer its industrial relations powers to the Commonwealth. This took effect on 1 January 2010. The practical impact of this decision is that the national workplace relations system, commonly referred to as Fair Work, now applies to all private sector employers and employees.
The award/s that applied in unincorporated workplaces prior to 1 January 2010 will not change as a result of the federal system now applying. This is due to a transmission period of one year (which commenced on 1 January 2010) providing for the recognition of state awards and Agreements, such as Certified Agreements, in the federal jurisdiction. From 1 January 2011, the relevant federal modern award will begin to apply, however this will be subject to transitional arrangements that have not yet been finalised.
Please note, the federal government may increase minimum wages during transmission period and QHA will update all wage rate sheets once the decision has been released.
