Federal IR & the Modern Award

The following information and resources will assist members in preparing for the changes introduced by the Fair Work Act 2009 and the modern Hospitality Industry (General) Award 2010:

  • National Employment Standards: Minimum conditions from 1 January 2010 applying to all employees.

  • Hospitality Industry (General) Award 2010: This copy of the Award is current as at 30 December 2009.

  • Fair Work Information Statement: The Fair Work Ombudsman has released the Fair Work Information Statement, one of the provisions of the National Employment Standards.  From 1 January 2010 employers are required to provide a copy of the Statement to all new employees as soon as practical after the employment commences.

  • Existing Agreement and the Fair Work Act: Members with existing Agreements such as AWAs, ITEAs, Collective or Certified Agreements are encouraged to read these instructions which provide guidance when determining whether the modern Award or National Employment Standards will effect the ongoing operation of their Agreement.

  • Modern Awards other than the Hospitality Industry Award: This guide will assist members in determining the correct modern award for employees performing in a position which does not fall under the classification structure of the Hospitality Industry (General) Award 2010.

  • Template Staff Memo: This template memo may be used by members seeking to inform staff of the changes that are commencing on 1 January 2010, such as modern awards and the NES, and how the changes will effect them.

  • ER Bulletin - 24 December 2009: This edition of ER Bulletin contains information relating to transitional arrangements and variations to be inserted into the Hospitality Industry (General) Award 2010.  Note, the Award copy as at 30 December 2009 incorporates these variations.

  • Transitional Provisions: This document is a copy of the Transitional Provisions as released by the Australian Industrial Relations Commission which will be inserted as Schedule A in the modern Hospitality Industry (General) Award 2010.  The ER Bulletin 24 of December 2009 provides further information about these provisions.

  • Comparison Guide - Hospitality Industry Award: This guide compares the federal Hospitality Industry - Accommodation, Hotels, Resorts and Gaming - Award 1998 with the new modern Hospitality Industry (General) Award 2010 which replaces all previously used federal Awards and NAPSAs from 1 January 2010.

  • Comparison Guide - Clerical NAPSA: This guide compares the NAPSA Clerical Award - Hotels, Resorts and Gaming - State (South East Queensland) 2002 with the new modern Hospitality Industry (General) Award 2010 which replaces all previously used federal Awards and NAPSAs from 1 January 2010.

  • Comparison Guide - Managerial Staff Award: This guide compares the federal Liquor and Accommodation - Hotels, Resorts and Gaming - (Managerial Staff) Award 2003 with the new modern Hospitality Industry (General) Award 2010 which replaces all previously used federal Awards and NAPSAs from 1 January 2010.

  • Comparison Guide - Hotels NAPSA: This guide compares the NAPSA Hotels, Resorts and Certain Other Licensed Premises Award - State (excluding South East Queensland) 2003 with the new modern Hospitality Industry (General) Award 2010 which replaces all previously used federal Awards and NAPSAs from 1 January 2010.

  • Template Termination Letter - as per NES requirement: This tempate can be used in order to comply with the NES requirement that an employee is notified of their termination in writing on the day of termination.

    Members are encouraged to be pro-active and find out more about the Act and how it will effect hotel operators.  Many elements of the legislation represent changes and moves away from the previous Workplace Relations Act 1996, in particular unfair dismissals and enterprise bargaining.
